Welcome to PeakForm Coaching ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the PeakForm Coaching mobile applications (iOS and Android) and website (collectively, the "Service").

By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you confirm that:

• You are at least 18 years old
• You have the legal capacity to enter into these Terms
• You will comply with these Terms and all applicable laws

2. Account Eligibility and Registration

2.1 Age Requirement

You must be 18 years of age or older to create an account and use the Service. By registering, you represent and warrant that you meet this age requirement.

2.2 Account Types

We offer two types of user accounts:

• Coach Accounts: For fitness coaches, trainers, and wellness professionals
• Client Accounts: For individuals seeking coaching services

2.3 Account Information

You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate and current
• Keep your password secure and confidential
• Notify us immediately of any unauthorized account access

3. Service Description

PeakForm Coaching is a platform that connects fitness coaches with clients, enabling workout programme creation, progress tracking, nutrition planning, habit tracking, and communication between coaches and clients. The Service includes automated monitoring and alert features to help coaches track client engagement and progress.

4. Subscriptions and Payments

Coach Subscriptions

Coach accounts require a paid subscription:

• Free: £0 (2 clients)
• Basic: £10/month (10 clients)
• Growth: £20/month (20 clients)
• Unlimited: £50/month (unlimited clients)

Client accounts are currently free of charge.

Cancellation and Refunds

• You may cancel your subscription at any time
• Cancellation takes effect at the end of your current billing period
• All subscription fees are non-refundable except where required by law

5. Health and Fitness Disclaimers

Physical exercise and dietary changes carry inherent risks. Before starting any fitness or nutrition programme:

• Consult your physician or healthcare provider
• Disclose any health conditions to your coach
• Stop exercising and seek medical attention if you experience pain, dizziness, or discomfort

You use the Service at your own risk. We are not liable for injuries, health issues, or adverse effects resulting from your use of the Service.

Coach Independence

6. Intellectual Property

You retain ownership of content you create. By uploading content, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

7. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your data. By using the Service, you consent to our Privacy Policy.

When you connect as coach and client:

• Coaches can view client progress, measurements, logs, and check-ins
• Clients can view coach-assigned programmes, workouts, and feedback

These Terms are governed by the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the courts of England and Wales for any disputes.

10. Changes to Terms

We may modify these Terms at any time. For material changes, we will notify you via email or in-app notification at least 30 days before changes take effect. Your continued use after changes constitutes acceptance.

The Service may include additional features not explicitly listed in these Terms. By using the Service, you agree to these features as they are introduced and implemented.
